This Consumer Health Data Privacy Notice (“Notice”) supplements the Hybrid Race Tools Privacy Policy and applies to Consumer Health Data, as defined by applicable U.S. state laws, that we collect or process in connection with Hybrid Race Tools. Given the breadth of certain U.S. state laws, some of the workout, fitness, profile, and device-permission data we collect may qualify as Consumer Health Data. Capitalized terms not defined in this Notice have the meanings given in the Privacy Policy.
1. Categories of Consumer Health Data We Collect and Why We Collect and Use It
Depending on how you use the Services, the categories of Consumer Health Data we collect may include:
(a) Workout, training, race, and activity data, such as workout type, start and end times, duration, distance, pace, splits, intervals, repetitions, sets, weight used, calories, race results, notes, and similar activity records. We use this data to record your activities, sync data across your devices, display workout history, power workout and progress analytics, generate summaries, and provide features you request.
(b) Health and fitness metrics that you enter or sync, such as heart rate, energy burned, body weight, body measurements, training load, and other health or fitness-related metrics or notes. We use this data to calculate and display statistics, trends, and historical progress and to provide user-requested features.
(c) Data from Apple Health, Apple Watch, Motion & Fitness, device sensors, and location-based workout features, but only if you enable the relevant permissions. We use this data to import, export, sync, record, display, and analyze your workout and fitness information and to support live workout tracking and route or location features you choose to use.
(d) Profile data that may describe your physical condition or fitness status, such as age or date of birth, sex, height, weight, goals, preferred units, and training preferences, if you choose to provide it. We use this data to set up your account, personalize the Services, and calculate workout and progress metrics.
(e) Inferences or insights derived from the data above, such as training summaries, trends, performance comparisons, consistency metrics, and other user-facing analytics. We use this data to help you review workouts, analyze progress, and use app features you request.
(f) Support communications that contain health or fitness information. We use this data to respond to support requests, troubleshoot issues, and maintain the Services.
2. Categories of Sources from Which We Collect Consumer Health Data
We may collect Consumer Health Data from:
(a) you directly, when you enter data, create an account, fill in profile fields, log workouts, notes, or races, or contact us;
(b) your device, Apple Watch, iPhone sensors, and app usage, when you enable relevant features or permissions;
(c) Apple Health / HealthKit, Motion & Fitness, location services, and other device permissions or integrations you enable; and
(d) third-party services or integrations you direct us to connect to or import from.
3. Categories of Consumer Health Data We Share
We do not sell Consumer Health Data.
We do not share Consumer Health Data with third parties or affiliates for advertising, marketing, or data broker purposes.
We may share the following categories of Consumer Health Data only in the following circumstances:
(a) workout, activity, training, race, and related health or fitness metrics, when you direct us to disclose them to a third-party integration you enable;
(b) limited support communications or limited relevant workout or fitness data, when reasonably necessary to respond to your support request;
(c) limited Consumer Health Data where disclosure is required by law or legal process or reasonably necessary to protect rights, safety, or the Services; and
(d) limited Consumer Health Data in connection with a merger, financing, acquisition, reorganization, or sale of all or part of our business, subject to applicable law.
4. Categories of Third Parties and Specific Affiliates With Whom We Share Consumer Health Data
We may share Consumer Health Data with the following categories of third parties:
(a) third-party integrations you choose to connect or direct us to share with;
(b) legal authorities or other parties where disclosure is required by law or reasonably necessary to protect rights, safety, or the Services; and
(c) a buyer, successor, investor, or other relevant party in connection with a corporate transaction, subject to applicable law.
Specific affiliates with whom we share Consumer Health Data: None currently.
5. How to Exercise Your Rights
Depending on applicable law, you may have the right to:
(a) confirm whether we are collecting, sharing, or selling your Consumer Health Data and access such data;
(b) withdraw consent relating to our collection or sharing of your Consumer Health Data; and
(c) request deletion of your Consumer Health Data.
Where required by applicable law, an access response will also include a list of third parties and affiliates with whom we have shared or sold Consumer Health Data and an active email address or other online mechanism you may use to contact them.
You may exercise these rights at any time through the in-app settings or other in-app flows made available in the Services, or by emailing [email protected]. We will not require you to create a new account to exercise these rights, although we may require you to use an existing account where appropriate and may need to verify your identity.
If you request deletion of Consumer Health Data, we will delete it from our records as required by applicable law and will notify relevant affiliates, processors, contractors, and other parties as required by applicable law. If Consumer Health Data subject to a deletion request is stored on archived or backup systems, deletion may be delayed only as reasonably necessary to enable restoration of those systems and, where applicable law requires, will not exceed six months after we authenticate the request.
6. Appeals
If we refuse to take action on your request, you may appeal by replying to our response or emailing [email protected] with the subject line “Consumer Health Data Appeal” within a reasonable period after you receive our decision. Our appeal process is intended to be similar to the process for making the original request. We will respond to appeals within the time required by applicable law. If we deny your appeal, we will provide information about any further complaint mechanism available to you under applicable law, including where applicable how to contact the Washington State Attorney General.
