Pono Software Inc. (“Pono Software,” “Hybrid Race Tools,” “we,” “our,” or “us”) operates the Hybrid Race Tools website at hybridracetools.com, the Hybrid Race Tools watchOS and iPhone applications, and related services (collectively, the “Services”). This Privacy Policy explains how we collect, use, disclose, and protect personal information when you use the Services.
For most personal information described in this Policy, Pono Software Inc. is the organization responsible for that information.
For individuals in the United States, please also refer to our Consumer Health Data Policy.
1. Scope of This Policy
This Policy applies to personal information we collect through the Services, including through our website, apps, customer support communications, and related interactions. Our separate Consumer Health Data Privacy Notice supplements this Policy for data that may qualify as “consumer health data” under applicable U.S. state laws. This Policy does not apply to third-party websites, services, or platforms that we do not control, including the Apple App Store, Apple Health, or other third-party products that have their own privacy policies.
2. Personal Information We Collect
We may collect the following categories of information:
(a) Account and contact information. Name, email address, username, password, account identifier, country or region, and similar registration details.
(b) Profile and settings information. Information you choose to add to your profile or settings, such as display name, age or date of birth, sex, height, weight, training preferences, goals, units, and notification preferences.
(c) Workout, training, race, and fitness data. Information you create, log, upload, or sync through the Services, such as workout sessions, race entries, times, splits, pace, distance, duration, repetitions, weights, heart rate, calories, notes, tags, body metrics, and related health or fitness information.
(d) Apple Health / HealthKit and device sensor data. If you enable these features, we may read or write the specific health, fitness, motion, or workout data you authorize through Apple Health / HealthKit, Apple Watch, Motion & Fitness, or other device permissions.
(e) Location data. If you enable GPS or route-related features, we may collect location data during your workouts or sessions.
(f) Purchase and transaction information. Subscription status, purchase dates, renewal status, receipt data, transaction identifiers, and limited billing details. Payment card data is generally processed by Apple or our payment processors, not stored directly by us unless expressly stated at checkout.
(g) Device, app, and usage information. Device type, operating system, app version, language, crash data, performance data, IP address, browser type, identifiers, and information about how you interact with the Services.
(h) Communications and support information. Messages you send to us, customer support requests, feedback, survey responses, and any attachments or information you choose to include.
3. How We Collect Information
We collect personal information:
(a) directly from you, when you create an account, log workouts or races, purchase features, contact us, or otherwise use the Services;
(b) automatically, through cookies, SDKs, logs, analytics tools, device permissions, and similar technologies when you use the website or apps;
(c) from Apple, app stores, payment processors, and similar providers in connection with purchases, subscriptions, authentication, or device functionality; and
(d) from Apple Health / HealthKit or other device integrations, but only if you choose to connect them and authorize the specific permissions.
4. How We Use Personal Information
We may use personal information to:
(a) create and manage your account;
(b) provide, operate, maintain, and improve the Services;
(c) log, sync, display, and analyze your workouts, training sessions, races, and related data;
(d) provide features you request, including Apple Watch, Apple Health / HealthKit, or other integrations you enable;
(e) process purchases, subscriptions, renewals, and customer support requests;
(f) communicate with you about service updates, account activity, security notices, and, where permitted, marketing communications;
(g) monitor performance, troubleshoot errors, detect abuse, enforce our terms, and protect the security and integrity of the Services;
(h) comply with legal obligations and resolve disputes; and
(i) create aggregated or de-identified information that does not reasonably identify you, which we may use for analytics, product improvement, research, and reporting.
5. Territorial Availability
The Services are intended for users in jurisdictions where we choose to make them available. At this time, the Hybrid Race Tools app, paid Services, and account-based Services are not offered to individuals located in the European Economic Area (“EEA”) or the United Kingdom (“UK”), and we do not market them to those regions. If you are located in the EEA or the UK, do not create an account, start a free trial, purchase a subscription or Lifetime Access, or use account-based or paid features of the Services. If we learn that the Services are being used from a location where we do not offer them, we may limit or terminate access and reject or cancel registrations or purchases to the extent permitted by law.
6. Health and Fitness Data; Apple Health / HealthKit; Consumer Health Data
Hybrid Race Tools is designed to help you record and review health, fitness, workout, training, and race information that you choose to enter or sync.
If you connect Apple Health / HealthKit, Apple Watch, Motion & Fitness, location, or similar device features, we access only the specific data that you authorize. You can change or revoke those permissions at any time through the Apple Health app or your device settings.
We do not use data gathered from Apple Health / HealthKit, Motion & Fitness, location data collected in a workout or health context, or other health and fitness contexts for advertising, marketing, or other use-based data mining. We do not sell such data to data brokers.
Where required by law, we collect or share consumer health data only with your consent or as otherwise necessary to provide the Services you request. Our separate Consumer Health Data Privacy Notice provides additional disclosures about data that may qualify as “consumer health data” under applicable U.S. state laws, including your rights regarding such data.
7. Cookies, Analytics, and Similar Technologies
Our website may use cookies and similar technologies to:
(a) remember your preferences and keep you signed in;
(b) understand how the website is used;
(c) improve performance, security, and functionality; and
(d) where permitted, measure marketing effectiveness.
Our apps may use analytics, crash-reporting, and similar technologies to understand performance and fix bugs.
Where required by law, we ask for consent before using non-essential cookies or similar technologies. You can control cookies in your browser settings and device permissions in your device settings, although some features may not work properly if you disable them.
8. How We Share Personal Information
We may share personal information with:
(a) service providers that help us operate the Services, such as cloud hosting, authentication, analytics, crash reporting, customer support, email delivery, and payment providers;
(b) Apple, app stores, and payment processors in connection with transactions, subscriptions, refunds, and device functionality;
(c) authorized personnel and contractors of Pono Software Inc. who need access to support Hybrid Race Tools, maintain systems, provide customer support, secure the Services, or comply with legal obligations;
(d) third-party services or integrations at your direction or with your consent;
(e) legal or regulatory authorities when required by law or when reasonably necessary to protect rights, safety, or the Services; and
(f) a buyer, investor, successor, or other relevant party in connection with a merger, acquisition, financing, reorganization, or sale of all or part of our business.
We require service providers to protect personal information and use it only for the services they perform for us or as otherwise permitted by law.
We do not sell personal information. We do not share personal information for cross-context behavioral advertising. We do not disclose health or fitness data to third parties for advertising, marketing, or data-broker purposes.
9. International Transfers
We are based in Canada and may use service providers in Canada, the United States, and other countries. As a result, your personal information may be processed outside your province, state, or country, where privacy laws may differ from those where you live.
Where required by law, we use appropriate safeguards for international transfers, such as contractual protections.
10. Data Retention
We retain personal information for as long as reasonably necessary for the purposes described in this Policy, including to provide the Services, maintain your account, comply with legal obligations, resolve disputes, and enforce agreements.
In general:
(a) account and workout data are retained while your account remains active and until you delete data, close your account, or request deletion, unless a longer retention period is required or permitted by law;
(b) transaction and tax records may be retained for longer periods to comply with accounting, tax, and legal requirements;
(c) diagnostics, security logs, and operational backups may be retained for limited periods as part of normal business continuity and security practices; and
(d) aggregated or de-identified information may be retained longer because it no longer identifies you.
When you request deletion, we will delete or de-identify personal information as required by law. Limited residual copies may remain in backups or logs for a reasonable period as part of normal disaster recovery, security, and business continuity processes. If data that qualifies as consumer health data is stored in archived or backup systems, deletion may be delayed only as reasonably necessary to enable restoration of those systems and, where applicable law requires, will not exceed six months after we authenticate the deletion request.
11. Your Rights and Choices
Depending on where you live, you may have the right to:
(a) access the personal information we hold about you;
(b) correct inaccurate or incomplete personal information;
(c) delete your personal information;
(d) obtain a portable copy of certain personal information;
(e) object to or restrict certain processing;
(f) withdraw consent where processing is based on consent; and
(g) lodge a complaint with your local privacy or data protection authority.
You may also have choices to:
(h) manage Apple Health / HealthKit, location, motion, and notification permissions through your device settings;
(i) unsubscribe from marketing emails using the unsubscribe link in those emails;
(j) delete content or change account information from within the Services where those features are available; and
(k) use any in-app settings, account tools, or request flows we make available to manage or delete your account and data.
To exercise privacy rights, request account deletion, or request access to or deletion of consumer health data, use the relevant in-app settings or request tools we make available, or email us at [email protected]. We may need to verify your identity before completing your request. We may deny or limit requests where permitted by law.
If we refuse to take action on a privacy request, you may appeal that decision by replying to our response or emailing [email protected] with the subject line “Privacy Appeal” within a reasonable period after receiving our decision. We will review and respond to appeals within the time required by applicable law. If we deny your appeal, we will tell you about any further rights or complaint options available to you under applicable law.
Please note that canceling or deleting your account does not automatically cancel an Apple App Store subscription. App Store subscriptions must be managed or canceled through your Apple account settings.
12. California Privacy Notice
If you are a California resident, California law may provide additional rights.
In the preceding 12 months, we may have collected the following categories of personal information described in the California Consumer Privacy Act, as amended: identifiers; contact information; commercial information; internet or electronic network activity information; geolocation data if you enable location features; diagnostics; user content; and sensitive personal information, including account credentials and health or fitness information you choose to enter or sync.
We collect and use this information for the purposes described in Section 4 and disclose it to the categories of recipients described in Section 8.
California residents may have the right to know/access, correct, delete, and obtain a portable copy of certain personal information. California residents may also use an authorized agent to submit requests on their behalf, subject to verification requirements.
We do not sell personal information. We do not share personal information for cross-context behavioral advertising. We do not use or disclose sensitive personal information for purposes other than those reasonably necessary to provide the Services, protect the Services, comply with law, or otherwise as permitted by applicable law. We will not discriminate against you for exercising your privacy rights.
13. Children’s Privacy
The Services are not directed to children under 13, and in some jurisdictions the minimum age may be higher. We do not knowingly collect personal information from children without appropriate authorization where required by law. If you believe a child has provided us with personal information in violation of applicable law, contact us and we will take appropriate steps.
14. Security
We use reasonable technical, administrative, and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure. These measures may include encryption in transit where appropriate, access controls, logging, and other security practices.
No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
15. Third-Party Services and Links
The Services may contain links to or integrations with third-party websites, apps, or services that we do not control. Those third parties have their own terms and privacy practices, and we are not responsible for them. We encourage you to review their policies before using them.
16. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. If we make material changes, we will post the updated version and revise the effective date above. Where required by law, we will provide additional notice.
